Leah Minicab Limited provides a Private hire facility through the Leah Minicab Service website/s and a phone service. Upon calling or registering with Leah Minicab Service on our website/s or through a phone service a user may book a Minicab Service. Using the website/s or a phone, Leah Minicab Service will identify you location. It will ask you to confirm the pickup location that has been identified is correct.
The service is being provided to you under these terms and conditions and any operating rules, policies, and procedures as currently published on this website and/or informed to users by Leah Minicab Service and/or its private hire drivers.
By using the service, you agree to be bound by all the terms and conditions found herein. If you do not accept all these terms and conditions, do not continue to use the service.
Permitted uses

Making Reservations through a Phones (Applications or any other methods)
By sending us or requesting a minicab booking request through Leah Minicab Service mobile, phone or website, a phone and Mobile services are subject to the limitations of the enabling technology on which they are reliant and may be adversely affected by network performance and other operational factors beyond our control,
including without limitation, congestion, network coverage, dropped connections, the performance of your mobile phone and the maintenance of secure network connections. Leah Minicab Service accepts no responsibility if you do not receive your booking confirmation or services for any of these reasons.
Furthermore, Leah Minicab Service will not be liable to you in any way for failures, defects, or delays in the delivery of the aforementioned booking confirmation or services that are caused by one or more of the following reasons: provision of an incorrect phone number before submitting the request, your mobile phone does not support such services, message inbox is full, mobile phone is out of range or un-contactable for some other reason, or you erase the information sent to you.
Changes to the service
Leah Minicab Service reserves the right, without liability, to change or discontinue any part of the service, temporarily or permanently, at any time (including any fees or charges for using the service). Leah Minicab Service will give the maximum amount of notice of such changes or discontinuance as is practicable in the circumstances. Notice of any changes to the service will be made available on the website and/or informed to users by Leah Minicab Service and/or its drivers.

Conduct
You agree that by booking a minicab or private hire vehicle through Leah Minicab Service you have agreed to meet the driver at the appointed location, make the journey as booked, and pay the full and correct fare. Leah Minicab Service reserves the right to bar users that inappropriately use the service.
Liability
Leah Minicab Service shall enter a contractual obligation as principal with the PERSON making a private hire booking to provide a journey, which is the subject of the booking, and any such contractual obligation must be consistent with the 1998
Act and The Private Hire Vehicles (London) (Operators' Licences) (Amendment) Regulations 2022.
Leah Minicab Service does not accept liability for any damages, including, without limitation, indirect or consequential damages, loss of profits, use of data, or any damages whatsoever arising out of, or in connection with the use or inability to use the service and/or associated websites (including information, advice, products, services, adverts, or links of third parties). Leah Minicab Service makes no representations or warranties of any kind whatsoever that the server behind our website is free of viruses or other components that may infect harm, or cause damage to your computer equipment or any other property when you access, browse, download from, or otherwise use the website. Leah Minicab Service is unable to ensure or guarantee the security of any information transmitted over the Internet. Any information or data which you transmit to or by using Leah Minicab Service and/or associated websites is done at your own risk and Leah Minicab Service shall not be responsible or liable for any damages or injury that may result from transmitting such information.

Limitation of Liability

(a) for death or personal injury caused by its negligence;
(b) for fraudulent misrepresentation or for any other fraudulent act or omission;
(c) to pay sums properly due and owing to the other in the normal course of performance of these Terms; or
(d) for any other liability which may not lawfully be excluded or limited.

(h) indirect, consequential, or special loss; arising out of or relating to these Terms and Conditions, whether or not such loss was foreseeable or if the party which would otherwise be liable for such loss was advised of its possibility (and, for the purposes of this clause
1.2, the term “loss”
includes a partial loss or reduction in value as well as a complete or total loss). Notwithstanding the foregoing, the exclusions in clauses 1.2(a) and (b) shall not apply to any loss suffered by Leah Minicab Service in the event of the user’s wrongful termination of these Terms.
1.3 Subject to clause 1.1, Leah Minicab Service shall not be liable, whether in contract, tort (including negligence), breach of statutory duty, under any indemnity or otherwise, for any loss, damage, expense, or liability incurred or sustained as a result of (a) the use of the Services in breach of these Terms and Conditions; and/or (b) any processing in accordance with the user’s Processing Instructions following the user’s receipt of that information.
1.4 Leah Minicab Service and the user agree that the Limitation of Liability section shall apply to any liability arising out of or in connection with these Terms and Conditions or any Contract.
1.5 Except as expressly set out in these Terms and contract and subject only to clause 1.1, no implied conditions, warranties, or other terms, including any implied terms relating to satisfactory quality or fitness for any purpose, will apply to the services or to anything supplied or provided by Leah Minicab Service or any related group under these Terms and conditions.
1.6 Clause of Limitation of Liability shall survive termination of these Terms.
Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of courts in England and Wales. These terms and conditions, as modified from time to time and/or including information given to users by Leah Minicab Service constitute the entire agreement between Leah Minicab Service and YOU with respect to the subject matter hereof. If any provision contained in these conditions is determined by a court of competent jurisdiction to be illegal, invalid, or otherwise unenforceable, that provision shall be severed from these conditions, and the remaining provisions shall continue in full force and effect.

The appointment of a minicab through Leah Minicab Service is free and incurs no additional charge to the user above regulatory charges (including pick-up charges) and fares. Any charges incurred using the Leah Minicab Service (such as but not exclusively, network charges) or website are the user’s sole responsibility.
By ordering a minicab through Leah Minicab Service (phones, mobiles or website) the user agrees to use the service and to pay all relevant fares.
By agreeing to these terms & conditions you – and anyone else using your account – agree to adhere to them and to be bound by them
Amendment or Termination of Service
Leah Minicab Service reserves the right to develop, improve or amend in any way the website and/or phone service.
Leah Minicab Service reserves the right to stop its services temporarily or permanently without informing the individual but in the case of this situation arising will do its utmost to keep people informed through its’ website.
Availability
The user is not entitled to the permanent and uninterrupted availability of the Leah Minicab Service. Leah Minicab Service undertakes to achieve maximum levels of service and availability in the case of an interruption to service to resolve it as quickly as possible.
Warrant & Liability Leah Minicab Service cannot warrant that information is always accurate, and complete and that it will reach the recipient in a timely fashion
Where information/data is incorrect, incomplete, or submitted late Leah Minicab Service cannot be held liable or responsible
